[40]
Counsel for the Applicant submitted that the Commission had failed to take into account the statutory guidance issued under the Physical Planning Act (Cap. 8.03) as revised in 2013, asserting that the earlier 2002 environmental provisions continued to constrain administrative discretion in the granting of utility development concessions.
[41]
The Court finds that the statutory framework governing utility tariffs under Cap. 8.03 must be read consistently with the public interest obligations established under the 2013 Revision. The discretion of the Commission is broad but remains strictly bounded by the legitimate expectations of concessionaires operating under statutory licences.

Applying the principles enunciated by the Court of Appeal in Hughes v. AG (2018), this Court holds that statutory powers cannot be exercised in a manner that defeats accrued contractual entitlements without express legislative sanction from the Legislative Assembly.
